David Mundell has repeatedly refused to say that the Tory government would not overrule a decision of the Scottish Parliament to withhold its consent on the EU Withdrawal Bill.

His appearance before Holyrood’s Europe Committee came shortly after the parliament’s Finance and Constitution Committee published their report on the Withdrawal Bill Legislative Consent Memorandum (LCM). The report concluded that the UK and Scottish governments should be treated equally and that Clause 11 of the Bill, which would impose significant restrictions on devolved legislatures, should be withdrawn.

The Secretary of State appeared to ignore the significant conclusions of the report, and refused to give a straight answer on whether restrictions would be imposed on the Scottish Parliament without its consent.

In repeatedly ducking the question, Mr Mundell compounded concerns that he will renege on his previous assurance that frameworks “should not be imposed”.

Commenting, Mairi Gougeon MSP said:

“The Tories now think they can do anything to Scotland and get away with it. David Mundell was asked directly and repeatedly whether the UK government would respect the will of the Scottish Parliament. His refusal to answer is deeply concerning.

“Despite the latest recommendation of the Finance and Constitution committee, it seems increasingly clear the Tories stand ready to ride roughshod over devolution.

“It wasn’t so long ago that David Mundell assured us that frameworks ‘should not be imposed’. If he truly has Scotland’s interests at heart and respects devolution, then he must not renege on that promise.

“To do so – against the express will of the Scottish Parliament – would demonstrate the Tories’ contempt for the devolution settlement that people in Scotland voted for."
